What "good faith effort" will hold up in court?

That is, how to avoid liability when gamblers in states where it is prohibited circumvent screening efforts and log on to use the site. Putting the responsibility on the online businesses leads not only to confusion as to which measures are necessary, but may disrupt the marketplace. Some current screening efforts to avoid this problem are considered inadequate, and could pose a liability.
