Grandparents' Rights - Georgia

Site: http://www.law.com/cgi-bin/nwlink.cgi?ACG=ZZZ7O7S7CDC

Is awarding custody of a child to a third party without a finding of parental unfitness a violation of the Constitution? Two cases filed in Georgia by grandparents seeking custody of their grandchildren may affect the state statute regarding third-party custody. Those in support of the statute claim it is not too broad and balances the interests of parents, their children, and interested third parties, but opponents argue that it violates the due process clause of the 14th Amendment.
